One of the ways that Georgia protects its residents, particularly drivers and pedestrians, is through its dump truck rules and regulations. The Georgia Department of Transportation and the Georgia General Assembly are responsible for creating and reviewing the dump truck laws. The purpose of the regulations is to ensure that Georgians are kept safe from hazardous materials and toxic waste materials. Vehicle Identification
Article 11 of the Official Code of Georgia mandates that dump trucks that carry aggregate material, such as rocks, sand, dirt and gravel, be marked so that traffic officials and other motor vehicle operators are readily aware of the type of material the truck is transporting. The law is designed so that traffic officials and other motor vehicle operators will be prepared to respond should the dump truck be involved in an accident or spill its contents. Failure to comply with the law could cause dump truck drivers and/or their employers to receive fines and penalties.
Illegal Dumping
Georgia's Litter and Waste Control Law prohibits the dumping of waste or garbage on public roadways, private property or in fields or forest areas. The law also prohibits dumping waste or garbage in Georgia waterways. Dump trucks must unload materials at authorized dumping sites. Truck drivers could be assessed a fine from $100 to $1000 dollars if they are found guilty of illegal dumping. Dump truck operators that illegally dump 500 or more pounds of waste will be charged with a misdemeanor the first time that they are found to be guilty of the illegal dumping. A second charge is deemed a felony and could result in a $25,000 fine and a two-year prison sentence.
Truck Loads
The Georgia Department of Transportation Standard Operating Procedure 10: Quality Assurance for Concrete Plans policy mandates that dump trucks carry no more than eight cubic yards of concrete on a single trip. Failure to comply with the regulation could cause the plant that owns the dump truck to be removed from Georgia's approved concrete plant list. Plant owners and engineers are responsible for ensuring that dump trucks are in compliance with the law.
